Google may digitize Vietnamese works for a fee

Vietnamâs literary works can earn millions if the countryâs literary copyright center manages to reach an agreement with Google by September 4, an official says. | |||||||
Director Doan Thi Lam Luyen of the Vietnam Literary Copyright Center said a failure to reach an agreement would mean no Vietnamese literary publication can be found with the worldâs leading search engine. As part of what is known as Google Settlement Agreement, Google will pay US$34.5 million to fund and establish a Book Rights Registry to maintain a database of copyright owners and their works, and to pay them. Through the registry, it will pay copyright owners 63 percent of revenues earned for specific commercial uses. Vietnamâs authors will benefit considerably from the agreement as Vietnam Literary Copyright Center that represents them will receive $300- 400 million in copyright payments from Google, Luyen estimates. But the center is worried about the agreement as it only represents, in terms of copyright, literary publications in Vietnam, which is a small number compared to nonliterary works including course books, dictionaries, reports and scientific books. âWithout a broad representation, Google may refuse to negotiate and sign a contract with the center and will not pay any copyright fees for Vietnamese authors and publishers,â Luyen said. Google recently sent a notice to the center concerning the agreement, reminding that Google will stand as the defendant in a lawsuit on October 7, about its right to use books outside the US. In 2005, the Authors Guild and certain authors and publisher representatives of the Association of American Publishers separately sued Google for copyright infringement. The parties reached an agreement last year, which if approved in the October 7 hearing, may affect almost every book in the world, and thus almost every copyright owner. The Google Settlement Agreement would allow Google to digitize nearly any work ever published before January 5, 2009. It will enable Google, the worldâs most popular Internet search engine, to index a work, display parts of the work, allow printing, copying and pasting, and annotations of the entire work, all at a fee subject to varying limitations. Luyen says she has asked the Ministry of Interior to extend the right of the center over more printed works in the country. She says she is also considering asking the government to grant the center an âopenâ license that allows it to have the right over the entire book collection in the country, whether the copyright owner of the book has authorized this or not. Readers of non-literary books in Vietnam outnumber those of literary books, Luyen said. âSo itâs not fair if literary authors are protected but nonliterary ones are abandoned.â A meeting was held in Hanoi on Thursday about the establishment of an association for non-literary authors, given that thereâs already a Vietnam Association of Writers for literary authors. Even if it manages to reach the agreement, the center is concerned about being sued by Google if it fails to force domestic websites to pay authors and publishers as much as Google does.
