The draft law on civil verdict enforcement should cover in more detail the structure of the agencies and requirements for opening private agencies for the purpose, delegates said at a National Assembly session Saturday.

Deputy Dang Van Khanh of Hanoi said the law should make clear provisions regarding the issuance of certificates for private civil verdict enforcement agencies.

However, the NA Standing Committee said the government would be entrusted to allow private enforcement agencies in certain localities, based on “specific conditions.”

The draft law also proposes that the government organizes the civil verdict enforcement structure.

“We should make the structure clear in the draft law,” said deputy Tran Du Lich of Ho Chi Minh City.

Deputy Dang Van Khanh noted that no agency has had direct authority over and management of the civil verdict enforcement law for many years.

“I wonder who would supervise the activities of civil verdict enforcement agencies,” said deputy Nguyen Thi Thuy Khiem of Long An Province.

She was referring to the National Assembly’s impending decision to do away with district level people’s councils that would normally supervise the civil verdict enforcement agencies.

Deputies also criticized a proposed procedure in the draft law which requires beneficiaries of a verdict to submit a petition requesting enforcement of the court’s decision.

“A court’s decision takes effect right after it is handed down,” said deputy Vu Duy Hoa of Thanh Hoa Province.
