| LookAtVietnam – National Assembly deputies have expressed their approval of the necessity to have a law on trade arbitrators.  | The issuance of the law would be a step to institutionalise the Party and Government’s policies in the country’s socio-economic development. | In their plenary discussion yesterday, November 25, they expressed their conviction that the law would help settle trade disputes quicker while keeping business confidential.They said the law would become a catalyst for more foreign investors and businesspeople to come to Viet Nam. The issuance of the law would be a step to institutionalise the Party and Government’s policies in the country’s socio-economic development, they said. Tran Quoc Khanh from Ha Noi and Le Van Tam from the Cuu Long (Mekong) Delta city of Can Tho laid emphasis on the competency of the arbitrators in the context of international economic integration. The arbitrators should have at least the BA in law or four years of experience in working in the judiciary or legal sector in addition to other requirements, including politics and foreign languages, they said. Nguyen Van Luat from the southern province of Kien Giang, Nguyen Dang Trung from Ho Chi Minh City, Chu Son Ha from Ha Noi and some others said a basic principle of trade arbitration was to reach agreement between parties and reconciliation. They said it was very important to define the legal status of arbitrators and the Arbitrators’ Council within the country’s legal system. They wanted the law to empower the Council rights to use temporary emergency measures at the request of parties involved in the disputes. They said such an empowerment was in line with the Law on Civil Litigation. Vu Tien Loc from the northern province of Thai Binh and Nguyen Thi Thu Ha from the central highland province of Gia Lai agreed with what has been written in the draft law on the concept of “trade” embracing the meaning of commodities, investment, services and intellectual property rights as well as real estate disputes. They asked the drafting committee to expand the power of the arbitrators in the settlement of disputes relating to trade and civil disputes. Regarding activities of foreign international arbitrators in Viet Nam, the majority of the deputies agreed with the draft law allowing them to practise their profession and to open their law firms in the country. But they said the law should have a special chapter with specific conditions including procedures to the establishment of branches for foreign arbitrators. Regarding the Law on Amendments and Supplements that applies to articles in the Education Law, the National Assembly Standing Committee (NASC) said that in the past three years, the law had helped develop the education sector and improve the quality of human resources. However, the Law on Education still has shortcomings concerning the conditions surrounding the establishment of schools, international co-operation, quality control, vocational training and university standards. The new law would boost the quality of education, the efficiency of State management in education and international co-operation in the sector, the NA reported. The new law regulates education standards for five-year-old children and creates a legal foundation for the State investments in pre-school education, with emphasis on schools in the country’s mountainous and remote provinces. The law also includes tighter regulations for secondary education programmes, details on the responsibilities of heads of universities and vocational schools, and requirements concerning the announcements about education quality. Under the Law on Natural Resource Taxation, resources like wind, solar energy and national parks and reserves are not subject to the law. The NASC said that they are encouraging the use of some natural resources like wind and solar energy. The resources will not be subject to tax, which is congruent with international rules. The State also encourages organisations and enterprises to take advantages of tourist locations in order to promote Viet Nam’s image to the international community, the NA reported.
