New procedures for arresting aircraft issued

On April 6 the President’s Office made public the Ordinance on the legal procedures needed to arrest an aircraft.

When introducing the main contents of the ordinance, the Permanent Vice President of the People’s Supreme Court, Dr. Dang Quang Phuong said that the ordinance comprises of four chapters and 49 articles, regulating the authority, process and procedures for the arrest of aircraft at airports in order to ensure the interests of creditors, owners or third persons who suffer losses or others who have related rights and benefits.

It also stipulates the authority, process and procedures for the release of an arrested aircraft.
According to the ordinance, provincially and centrally-run municipal people’s courts in the localities where an aircraft lands have the jurisdiction to order its arrest on the spot.

The duration that any aircraft can be kept in detention may not exceed 30 days since the day it is arrested.

The ordinance also sets out the grounds for the release of an arrested aircraft and the procedures to deal with a request for the release of any captured aircraft.

Phuong said that the People’s Supreme Court is preparing to ensure the new ordinance is carried out effectively such as holding training courses and issuing guidelines on the necessary procedures.
