To come forward and introduce partners contributing money to real estate projects but broker Linda Tan Woo (Vietnamese - Chinese resident) was accused of appropriating $6 million of her twin sister, Truong My Lan.
Linda was arrested by Investigating Security agency, but her case has been returned by the courts twice because of lack of evidence. So what’s going on?
According to additional investigation by Investigating Security Agency – Ministry of Police and a document by Supreme People Control Institute on November 8, 2009, President Linda Tan Woo of Vinh Tuong Co., Ltd. introduced CEO Truong My Lan of Van Thinh Phat Co., Ltd. to an Indonesian named Sioeng Ted in 2002.
Lan and Ted reached an agreement to contribute capital to An Dong 2 commercial district projects and 127 Pasteur (Sherwood Residence) apartment building in Ho Chi Minh City.
From February to July 2002, Ted gave Lan $6 million. But later, that amount of money became Lan’s debt because Ted didn’t want to invest any more.
Lan did nto pay him back, so Ted took her to court on May 27th 2005. The court received a letter from Lan denouncing Linda of appropriating $6 million, which she paid Ted through Linda.
On July 12th 2007, Investigating Security Agency decided to introduce it as a criminal case. Linda was sentenced in temporary detention.
Missing evidence
The only document that the Investigating Security Agency used to deal with Linda’s case was a confirmation letter that Linda signed on February 26, 2003 to sell $2 million worth of houses on 102 Cong Quynh street to Ted and Linda and received that amount as Ted’s representative.
The Investigating Security Agency judged that Linda assumed Ted’s name to receive the Cong Quynh $2 million house as part of Lan’s debt clearing, but did not pay Ted later.
When the case came before the court , it was rejected twice due to insufficient evidence showing Linda committed a crime.
Other evidence existed that the Agency did not requisition, a quittance confirmation signed on May 12, 2003 stating: “Until now (May 12th 2003), there was no difficulties in money, assets or debt between two.” So that document made the confirmation letter invalid.
People’s Procuracy Institute in Ho Chi Minh City acted on the Supreme People’s Procuracy Institute’s authority to execute the prosecution. They confirmed with Supreme People’s Procuracy Institute that there was not enough evidence. They argued that Lan and Linda are twin sisters and Lan had been supplied with tens of billions of dong from Linda to do business.
If Linda wanted to appropriate $2 million that Lan paid to Ted, then why would she supply capital to Lan?
So, after being out on bail, Linda drew up petition and sent it to appropriate authorities with contracts that showed Linda had supplied Lan with 80 billion dong in capital. At least 13 billion dong in capital, signed on January 28, 2004 was confirmed by the Criminal Science Institute.
A case without victim?
After the postponed decision, Ted withdrew his petition in which he sued Truong My Lan (defendant) and Lan also withdrew her petition suing Ted.
On withdrawing the petitions, both sides wanted goodwill and to resolve the case.
So, the $6 million case was solved, but the consequence still remain.
In detail, on March 26th, Linda sent an urgent petition to the National Assembly Judiciary Committee Chair and the Supreme People Control Institute President and Minister of Police. She proposed postponing the criminal case begun on December 27, 2007.
In the end, after all the time and money expended, is no one victim in this case?
